Just checked mine after reading this.

My xval has 1 failed ap25 challenge since november 2010, logged onto live and no update for me either all fine.

Sure it's not a game update?

Out of interest what do peoples K: numbers say?

Well... Just called him and he said he updated it but no ban. I asked him if it was a game update and he said no, it was just an update when he signed into live (no game in system). He doesn't notice anything new or different on the dash. I'll have to check his dash # when I go over there tomorrow.

If youve got a AP 2.5 Failed Challenge flag on the xval that checks the Nand i would say sell it quick before you get a ban.. Thats what i did with mine. Now i got a clean sec date and i freshly flashed mine with LT 1.9 with the July 19th dash update. Happy days

Hmm weird, unless the update yesterday failed to install or restart so it did it today. dunno

DBX i'm confident they won't ban me for 1 ap25 fail, it was just after the ap25 came in so how could they possibly prove it wasn't the faulty copy of fable 3 i rented from the video store ^^ which is exactly what I will be saying to them if they ban me.

There is not a single case of a person who managed to revert a ban somehow. So it does not matter what you tell them. If you are banned, you are banned.
