In the UK I think the law states something like if you own a game you have the right to back it up etc to computer and re burn but you are unable to sell it so I guess as long as you can prove you have the original when asked too its fine

But what the other guy is doing is illegal as he is selling them for financial gain

Yes but here we have to make our own backup and cant have it done by someone else then its illegal.
But since this is a US server the site would still have to obey to that US rule or it may get shut down.

Its legal there I know but not here its also in our rules
