The update will not work, I believe it's the console itself that gets updated, not the hdd because I think you can update without the hdd inserted.

Also you can't get banned or flagged by only your hdd. Your modified console itself has to go online in order to get banned/flagged. Your hdd can't get banned, it will only be corrupted, that is that you'll lose your save games or achievements and have to recover your gamertag.

You can also apply the update offline with an usb stick. So you won't have any risk of being banned.

Yes i do know that you can update offline, but after I searched around on updating the newest update from April 06, 2010 with usb, I found that you still have to go online and update after the xbox restarts.

You can install the first part of the update offline from usb, but then the second part of the update doesn't start until after you sign into Live.

I had problems with my drive when trying to flash it so I am trying as hard as possible to find a safe way of updating without reflashing.
